But simple trespassing? |
There is no such thing as "simple trespassing" at 11:00 PM in very remote rural areas, as anyone who lives on a ranch anywhere would tell you. If one is smart they are even very suspicious of anyone approaching the house late at night via the driveway from the road. In my case the house is about 500 feet from the road. That's why everyone around here locks the gates across their drives at night. Anyone caught on the property has entered by cutting a fence or the locks on gates, a criminal act to begin with. |

Read the law, bonehead. Unless the trespasser was unlawfully attempting to enter your house or car, you had no right to shoot under the Texas Castle law. You are really lucky that you are a lousy shot.

Perhaps you should read the details of my post(s) for understanding. But then it's too much to expect of you read anything for understanding. You just want to argue your silly position gun control as per usual.
There is one thing I can assure you of, and that is no person in Texas has ever been charged or indicted for shooting anyone for being on their property under circumstances where their personal safety or security of their property is involved, that even extends to your neighbors property in most circumstances. I.e., if you observe someone stealing from your neighbor you may also act without trepidation.
And by the way, your link citings are out of date by roughly ten years or have been revised.

Try to keep up. JK's trespasser was NOT breaking into his house, just walking up the 500' driveway when JK took a wild potshot at him. _________________ "Should'a never taken Willoughby out." |

Well, there's where not reading for understanding bites you right in the ass again Swede. I never said I fired at anyone on my driveway. In fact when I fired a shot I was was nowhere even close to the drive. You are the one that needs to keep up. Making assumptions will make the fool of you, you are every time. |

Hey, blast away, JK. You seem to get your jollies from it.
What if that had been a unarmed neighbor whose car broke down and he was walking up your driveway for help? If you had shot him dead are you absolutely certain there would be no charges?

You said: | Quote: | | Interesting fact: Last night I found it necessary to take a shot at a trespasser at around 11:00 PM. First time in about a year we've had that problem. Don't think I hit him but I'd have been ecstatic had I blown his friggin' head off. |
Swede said the alleged trespasser was on the drive, not you. Who knows...
He based it on your statement: | Quote: | | In my case the house is about 500 feet from the road. That's why everyone around here locks the gates across their drives at night. Anyone caught on the property has entered by cutting a fence or the locks on gates, a criminal act to begin with. |

You presume I couldn't tell a neighbor from a total stranger. You presume I would fire on someone without attempting to determine why they would be on my property. You presume I would enjoy blasting away at just anyone. While it is true I have taken out a significant number of combatants, more than I can remember, I'm not running around looking for excuses to blow anyone away.
Now for the big assumption you made. You assumed by "trespasser" I was talking about a person. In this case it was the biggest damn male coyote I've ever seen........hee, hee....gotcha! |
